Definition
- Knowingly,
- Cultivating marihuana, or
- Manufacturing or engaging in the production of a controlled substance.
Potential Penalties
Illegal manufacture of drugs or cultivation of marihuana can be considered a felony of either the first, second, third, fourth, or fifth degree depending on the type and amount of drug as well as the vicinity of the cultivation to a school. As such, there can be a wide variety of potential penalties that the prosecution can seek to impose.
