Definition of Loitering To Engage in Solicitation
- With purpose to ask another to engage in sexual activity for hire while in or near a public place,
- Stopping another person or engaging them in conversation.
Potential Penalties
Loitering to engage in solicitation is a misdemeanor of the third degree and can be penalized by up to 60 days in jail and a $500 fine. If person who is loitering has tested positive for HIV, loitering becomes a felony of the fourth degree and is penalizable by 6-18 months in jail and a fine of up to $5,000.
