Definition of Soliciting
- Asking for a paid sexual activity.
Overview and Potential Penalties
Solicitation is generally a misdemeanor of the third degree and is punishable by a jail sentence of up to 60 days and a fine of up to $500. If it is known that the person being solicited is 16 or seventeen years old or is reckless in that regard, it becomes a felony of the fifth degree, which is punishable by 6-12 months in prison and a fine of up to $2,500. If the person being solicited is less than 16 years old, a violation is a felony of the third degree, which is punishable by 9-60 months in prison and a fine of up to $10,000. Likewise, a person engages in solicitation after a positive HIV test, a solicitation is a felony of the third degree, punishable by 9-60 months in prison and a fine of up to $10,000. This Ohio law forbids not only buying, but also selling a paid sexual activity and does not require a seller to be a professional.
