Elements of Robbery
- Committing or attempting to commit a theft,
- With a deadly weapon, or
- While Inflicting or threatening to inflict physical harm on another.
Potential Penalties
Robbery is distinguished from the lesser crime of theft in that there is an extra element of actual or potential harm. Robbery can be a second-degree felony with a prison term of 2-8 years and a fine of up to $15,000, or a third-degree felony with a fine of 1-5 years and a fine of up to $10,000.
